The personal data acquired by Medical Pharm Ltd. during registration shall be used for the purpose of serving Users only, including order delivery and in connection to any order issues. The data shall not be provided to third parties in any form nor used for any purposes other than the ones specified above.

Medical Pharm Ltd. shall collect the following user information:

• The information provided by natural persons shall be classified as personal and kept as such by the personal data administrator – Medical Pharm Ltd. If the User refuses to provide their personal data, they shall not be able to make use of the goods and/or services offered by Medical Pharm Ltd.

 

Personal Data Safety

The User shall bear full responsibility for the safety of the usernames and passwords, as well as for the activities of third parties in connection to them. In case of any suspicion of illegal or unauthorised access, stolen or lost name and/or password, the User shall immediately inform Medical Pharm Ltd., so as to terminate the access to the personal data.

Medical Pharm Ltd. shall provide a high level of data protection with the use of the services of the website, through encryption.

The User shall be obliged to keep their personal data up-to-date and to correct in a timely fashion any address, phone number, or e-mail if those have been changed. Medical Pharm Ltd. shall not be liable for any undelivered orders resulting from obsolete information and these orders shall be re-sent at the User’s expense.

 

ORDERS, PAYMENT, DELIVERY, AND EXECUTION TERMS AND CONDITIONS

The Medical Pharm Ltd. online store shall accept orders 24 hours a day, 7 days a week. Each selected product shall be put into the cart. Before confirming their order, the User may review their cart, correct the amount and information, and then confirm it.

By selecting a payment method and confirming the order, the User shall be obliged to pay its final price. After the request, the online store system sends an e-mail confirming the order.

The order delivery may be delayed due to: User’s wrong or incomplete delivery address or contact phone number.

 

Prices and Payment Method

The final price of the order shall be the sum of the prices of all the ordered products, with an included specified delivery price.

All the prices are in Euro, VAT inclusive, and shall not be subject to change within the period between the time of ordering and the time of payment.

The prices of the goods are ex-warehouse of Medical Pharm in Bulgaria. The buyer may pay the transportation costs under the Terms and Conditions specified below.

Any potential costs connected to the import of the goods to a third country specified by the Buyer as the place of delivery, including such regarding the payment of customs duties, taxes, fees, etc., which could occur when the goods are delivered outside the territory of the Republic of Bulgaria, including such costs connected to the custom’s arrangement of the import of the goods in a third country, shall be at the Buyer’s expense. The Seller – Medical Pharm Ltd. – shall not be liable for or bound in any way by the performance of activities connected to the above or with the payment of any amounts.

 

The accepted payment methods shall be as follows:

• Debit/credit card through PayPal/Virtual POS terminal

  BY CREDIT/DEBIT CARD – When paying by bank card, the User is transferred to the PayPal online card payment system, where they submit their bank card data and pay the amount due.

• PayPal account: Through an existing PayPal account.

Medical Pharm Ltd. does not require nor does it receive any additional fees, regardless of the payment method. All the fees accrued in addition to the order and delivery amount specified by Medical Pharm Ltd. are subject to contractual relations between the User and their servicing bank/agent.

Medical Pharm Ltd. does not store any information about card holders, including card numbers, as this data is processed only by the intermediaries’ Virtual Payment System.

The bank cards you can use to make online payments are as follows: MasterCard, Maestro, Visa, V Pay, Visa Electron.

Please, check whether your issuer has opened your card for online transactions.

 

The data the client should submit for card payment are as follows:

Card data (number, expiry date, 3-digit security code, card holder name, address).

Identification data

In order to identify you as a card holder, our online shopping payment server of our servicing bank supports the identification schemes of international card organizations – Verified by VISA and MasterCard SecureCode. Providing you are registered in the security schemes by your Issuing Bank, your screen will show a webpage where you must type your password.

The transaction currency (the one which is displayed on the payment webpage during the purchasing process) is EURO.

 

Delivery Method, Terms and Price

Medical Pharm Ltd. offers the following delivery methods:

• Deliveries to the European Union, Iceland, Liechtenstein, Norway, and Switzerland (EU+EFTA):

DHL courier company delivery prices and terms and conditions:

• Your order is delivered by DHL courier company to the address specified by you, on weekdays, from 09:00 to 18:00.

The delivery price is:

• The price for Zone 1 – the European Union, Iceland, Liechtenstein, Norway, and Switzerland – is 19.90 euro

No minimum amount or weight limits.

The stated prices are valid only for deliveries with DHL courier company, on the territory of the European Union, Iceland, Liechtenstein, Norway, and Switzerland (EU+EFTA):

 

Term of Delivery

The term of delivery to the final destination selected by the User is up to 15 working days for the territory of the European Union, counted as the day on which the order was placed.

USERS’ agreement rejection RIGHTS UNDER THE CONSUMER PROTECTION ACT. Execution Terms and Conditions:

The User may cancel their order before it has been prepared for delivery by a courier or before the actual delivery to the address specified by the User – through an explicit statement expressed in writing at orders@medicalpharm.eu.

The User shall have the right to check the contents of their order before accepting it by the courier company.

The User shall have the right to reject the Agreement, without stating a reason, without owing any compensation or penalty, and without paying any costs, within 14 days, counted as of the date on which the User or a third party different from the forwarder and specified by the User accepted the goods – in cases of a Sales Agreement, or:

• if the User has placed a bulk order for a lot of goods which shall be delivered separately, counted as of the date on which the User or a third party different from the forwarder, within 14 days, counted as of the day of accepting the last item;

• in case of delivering goods comprising multiple batches or parts, counted as of the date on which the User or a third party different from the forwarder, within 14 days, counted as of the day of accepting the last batch or part;

When the User exercises their right of rejecting the Agreement, the User shall send us or shall return the goods without any unreasonable delay and no later than 14 days, counted as of the date on which the User has announced their decision to reject the Agreement. The deadline shall be considered as met if the User sends us the goods or returns them to us prior to the expiration of the 14-day term.

In this case, the User shall pay only the direct return costs, as well as any additional costs incurred for delivering the goods, when the User has explicitly chosen a way of delivering the goods which is different from the cheapest standard delivery offered by the retailer. All the costs the User has incurred for the receipt and return of the purchased goods, any bank commissions, and other costs in addition to the amount of the ordered products shall be at the User’s own expense.

It is considered that the User has exercised their right to reject the Agreement if they have sent us a message of exercising their right of rejection before the term specified above.

Providing the User has exercised their right to reject the Agreement, they must return the goods in the undamaged original package (envelopes and other packing materials used for the transportation of the goods different from the factory packaging of the goods are not considered a package; unsealed cellophane shall be considered broken package), intact and unused, so as to prevent a reduction of their value caused by testing the goods in a manner that differs from the one necessary to test their nature, characteristics, and good functioning.

The User shall be obliged to store the goods with appropriate care and in compliance with the manufacturer’s storage instructions, by the date of its returning to Medical Pharm Ltd..

In case of failure to perform these Terms and Conditions, Medical Pharm Ltd. shall reserve the right not to accept the returned goods and consequently not to refund the total amount paid by the User.

If the User has exercised their right to reject the Agreement, Medical Pharm Ltd. shall refund the amount paid for the product/-s within 14 days using the same payment method used by the User in the original transaction unless the User has expressed explicitly their desire for the use of another payment method and on condition that this is not connected to costs incurred by the User.

If we have to refund an amount paid by card for contractual services provided by us, then this refund shall be paid by us via credit transaction to the card used for the payment to us.

The User shall not have the right to reject the Agreement in the following cases:

• delivery of goods whose quality may deteriorate or which, due to their nature, have a short shelf life;

• delivery of sealed goods which have been unsealed after the delivery and cannot be returned due to hygiene and health protection considerations;

• delivery of goods which, after their delivery, have been mixed with other goods and cannot be separated from them, due to their nature.

We remind you that for the goods that we sell there is a legal warranty in place that guarantees the goods conform with the Sales Agreement.

Please note that, if applicable to the particular goods, information is provided on the possibility of providing assistance to the User after the sale, on the presence of out-of-warranty service, and of commercial warranty, as well as on the terms and conditions applied to them.

The User’s right to return the product purchased from us is INAPPLICABLE for MEDICINAL PRODUCTS and MEDICINAL SUPPLIES.

 

Complaint

When delivering orders to persons who are treated as users under the Consumer Protection Act and the Act on the Provision of Digital Content and Digital Services and the Sale of Goods, Medical Pharm Ltd. shall send the goods which the User has purchased and which are to meet the individual requirements of conformity with the Agreement, namely, to correspond to the description, type, quantity, and quality and to have the functionality, compatibility, interoperability, and other characteristics listed in the Agreement as well as the objective conformity requirements and the requirements regarding lack of conformity resulting from improper installation of the goods, as far as this is applicable.

The User may refuse to receive the goods at the time of delivery by the courier and to take it from them, if the package of the goods is broken or torn at the time of receipt.

Provided that the consumer goods do not meet the individual requirements for conformity with the Agreement, the objective conformity requirements, and the mounting and installation requirements, the User shall have the right: to make a complaint and ask the retailer to bring the goods into conformity; to receive a proportionate reduction in the price; to terminate the Agreement. The User may exercise the above-mentioned rights within up to two years, counted as of the date of delivery of the goods. When the consumer goods are not in conformity with the Sales Agreement, then we will address the lack of conformity at our sole expense, within a reasonable timeframe (of up to a month), counted as of the day on which we receive your complaint.

All complaints shall be submitted by you or by a person authorized by you and shall be sent to the e-mail address specified in this website – orders@medicalpharm.eu – or to the company’s head office.

A complaint shall be deemed received on the day it is received in the Medical Pharm Ltd.’s e-mail.

Goods are not subject to complaint when the User has been explicitly informed beforehand that some characteristics of the goods do not meet the objective conformity requirements and the User has explicitly accepted this nonconformity with a statement at the conclusion of the Sales Agreement.

When submitting your complaint you must include the following information:

• the subject of the complaint

• your preferences as to the manner in which the complaint shall be addressed

• the respective value of the claimed amount

• contact address

When submitting a complaint you must apply documents which support the claim; a receipt/invoice; documents identifying the nonconformity of the goods or services with the Agreement; other documents proving the grounds and the amount of the complaint.

Provided that the delivered goods are not in conformity with the Sales Agreement, then the User shall have the right to submit a complaint and request that the goods be brought into conformity with the Agreement by being repaired or replaced at our expense. Medical Pharm Ltd. may refuse to bring the goods in conformity with the Agreement if the repair and replacement are impossible or would lead to disproportionately high expenses for Medical Pharm Ltd. considering the circumstances of the particular case. The User shall have the right to request a proportionate reduction in the price or to cancel the Sales Agreement when we refuse to repair or replace the goods or refuse to bring them into conformity with the Agreement; when the goods are still nonconforming despite the measures we have taken to bring them into conformity with the Agreement; when the nonconformity is so serious that this justifies immediate reduction in the price or cancelling the Sales Agreement; or when we will not be able to bring the goods into conformity within a reasonable timeframe or without causing any significant inconvenience for the User.

If the User has chosen a price reduction, then it is reduced in proportion to the value of the goods received by the User and the value which the goods would have if they were conforming.

If the User has chosen to exercise their right to cancel the Sales Agreement, they shall be obliged to return the goods to Medical Pharm Ltd. without any unreasonable delay and no later than 14 days, counted as of the date when they informed us of the decision to cancel the Agreement. The deadline shall be considered met if the User has returned or sent the goods back to the retailer before the expiry of the 14-day term. After the User has received the goods or has provided evidence of their sending to Medical Pharm Ltd., the User shall be refunded the amount they paid for the goods. The amount shall be refunded to the same payment method used by the User in the original transaction unless the User has explicitly expressed their consent for the use of another payment method.

The User shall not have the right to cancel the Agreement if the nonconformity is insignificant.

A complaint about goods shall not be accepted if those are past their expiry date.

The costs incurred for bringing the goods into conformity with the Sales Agreement, as well as the shipping costs, including the costs for the goods redelivery, shall be at Medical Pharm Ltd.’s expense.

Regarding consumers who are not classified as Users under the Consumer Protection Act and the Act on the Provision of Digital Content and Digital Services and the Sale of Goods, the general procedure of complaints under the civil and commercial legislation shall be applicable.
